Terms of Service

1. Acceptance of Terms

By accessing or using the UTRAX platform (“Service”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

2. Service Description

UTRAX is an event photography platform that enables photographers to capture, organize, and deliver photos to event attendees via QR ticket registration, SMS notifications, and personal online galleries.

3. User Accounts

Photographer admin accounts are required to create events, upload photos, and manage galleries. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

4. Attendee Terms

  • Registration — By scanning a QR ticket and providing your phone number, you register as an attendee for that event.
  • Model release — By registering, you grant the event photographer a limited, non-exclusive license to capture and distribute your likeness in photos taken during the event, as described in the model release presented during registration.
  • Photo consent — You acknowledge that photos may be taken of you during the event and delivered to your gallery. You may request removal of specific photos by contacting the photographer or UTRAX support at hello@utrax.co.

5. SMS & Text Message Terms

By providing your phone number during event registration, you expressly consent to receive text messages from UTRAX and the event photographer's organization at the phone number you provided. You understand that:

  • You will receive photo-ready notifications when your edited event photos are available (typically 1 message per event).
  • You may receive verification codes when you request to look up your photos using the “Find My Photos” feature.
  • Message frequency varies. Expect 1–2 messages per event you attend. Verification codes are sent only when you request them.
  • Message and data rates may apply based on your mobile carrier plan.
  • Consent to receive text messages is not a condition of purchasing any goods or services.

To opt out: Reply STOP to any UTRAX message at any time. You will receive a confirmation and no further messages will be sent.

Supported carriers include T-Mobile, AT&T, Verizon, and all major US carriers. Carriers are not liable for delayed or undelivered messages.

6. Photographer Obligations

  • Data handling — Photographers must handle attendee data responsibly and in accordance with applicable privacy laws. Attendee information must not be used for purposes outside the UTRAX platform without explicit consent.
  • Content standards — Photographers must not upload content that is illegal, harmful, abusive, or violates the rights of others.
  • SMS responsibility — Photographers who trigger SMS notifications are responsible for ensuring they have valid attendee consent and that messages are sent only to registered event attendees.

7. Intellectual Property

Photographers retain all intellectual property rights to the photos they upload. UTRAX does not claim ownership of photographer content. By using the Service, photographers grant UTRAX a limited license to host, display, and distribute their photos solely for the purpose of delivering the gallery experience to attendees.

8. Limitation of Liability

UTRAX is provided “as is” without warranties of any kind, express or implied. To the maximum extent permitted by law, UTRAX shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of data, lost photos, failed or delayed SMS delivery, or interrupted service.

9. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or the platform. Upon termination, your right to use the Service ceases immediately.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in the State of Florida.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated “Last updated” date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
